Is a DUI a felony in Alberta?

Defending impaired driving prosecutions and resisting IRS administrative penalties under Alberta’s new DUI legislation is very technical and often involves defences under the Canadian Charter of Rights and Freedoms. Not every criminal lawyer truly understands how to defend DUI cases.

Many people think that a calgary dui lawyer will only help them when they are caught “drunk driving”, which refers to operating a vehicle while over the legal blood alcohol limit (BAC). However, it is not uncommon for police to investigate other types of impaired driving offences, such as “at 80” and refusing to blow, even if an accused is below the legal BAC level.

Alan Pearse wrote the book on breathalyzer equipment and roadside sobriety testing (The Guide to Breathalyzer Certificates in Canada, published by Canada Law Book). His practice is 100% DUI litigation, and he has handled thousands of these cases since 2000. He is a member of the Law Society of Alberta and regularly gives lectures to lawyers and law students on these topics. He has also written numerous articles on DUI and related issues in his monthly newsletter, the ‘Alan Pearse Impaired Driving Newsletter’.
